Phoenix man without car for months as insurance fails to pay for repairs

A Phoenix man has been without his BMW for months following a crash and while the car is fixed, the insurance company still hasn't paid the auto shop.

PHOENIX (AZFamily) — A Phoenix man said he has an ongoing problem with an insurance company, and it’s caused him to be without his car for months.

Greg Irwin said he fell in love with his 2012 BMW when he bought it two years ago. “We found a Sun City special, which an older individual had,” Irwin said. “It was a BMW and it’s in great condition. Only has 65,000 miles on it.”

But unfortunately, Irwin‘s Sun City special was involved in a collision back in December just off of Camelback Road and 24th Street. According to Irwin, his wife was turning right onto 24th Street from Missouri and so was a truck right next to her. “There’s a Cox communication van sitting on the right-hand side doing the same thing as she turns into the right, the Cox communication merges into her lane and side swipes the whole area and from that standpoint, knocks her up on the curb,” he said.

Phoenix Police responded to the scene and wrote up a police report. But according to the report, no one was cited. As for Irwin’s BMW, it was eventually taken to a collision center where repairs were reportedly authorized for just over $5,000.

This is where things get messy. Irwin’s BMW has been fixed and is ready to be picked up for four months. However, Irwin claims Cox’s insurance company won’t pony up the money for the repair. “It gets repaired in the month of January,” Irwin said.

“Now the repair center wants to be paid?” On Your Side’s Gary Harper asked. “Of course they would. Yes,” Irwin said. Irwin says he can’t turn the issue over to his own insurance company because he only has liability.

On Your Side has reached out to Cox as well as their insurance company to investigate. But while they both look into the matter, Irwin remains frustrated and without his BMW. “I’m in a rock and a hard place. I’m not even asking for any extra. I just want the bill to be paid so we can have our vehicle back. I’m not a greedy person by any means, but the fact of the matter is, this it’s like, it’s right and wrong thing, period,” Irwin said.

Fortunately, the repair shop is not charging any storage fees that would add to the bill. On Your Side will stay on top of this issue, and we’ll let you know what happens in a follow-up news report.
